Cookie Policy

I. Introduction

1.1 This Cookie Policy explains which cookies and similar technologies are used by the Nemify (Property Due Diligence) web application available at https://nemify.cz.

1.2 The operator is Smart Assets s.r.o., Company ID 21461104, with its registered office at Veletržní 819/75, Holešovice, 170 00 Prague 7 (the "Operator").

1.3 This Policy is governed by the GDPR, Act No. 127/2005 Coll., on Electronic Communications, and the recommendations of the Office for Personal Data Protection.

II. What Cookies Are

2.1 Cookies are small text files that a website stores on the User's device.

2.2 Similar technologies: Local Storage, Session Storage, Web beacons, Fingerprinting.

The Operator writes only cookies to the User's device. It does not itself use local storage, session storage, web beacons or fingerprinting. The Vercel Analytics script (loaded only after consent) may read the __va_attribution key from local storage if another website stored it there earlier; the Service does not write this key.

III. Which Cookies We Use

a) Necessary Cookies

These are cookies technically required for the Service to work (session, form protection, access to a purchased report, storing the cookie choice) and functional cookies that remember settings chosen by the User (language, appearance). All of them are first-party cookies.

Legal basis: legitimate interest of the Operator. These cookies do not require consent under Section 89(3) of the Electronic Communications Act, because they are necessary to provide the service explicitly requested by the User (including storing settings the User chose).

The Service also uses error monitoring through Sentry, which does not store any cookies. Sentry receives error reports only; each error is sent together with a short technical trail of preceding steps (navigation, network requests, console output), from which e-mail addresses, IP addresses and form contents are removed before sending. It is processed on the basis of the Operator's legitimate interest under Article 6(1)(f) GDPR in conjunction with Recital 49 GDPR (ensuring network and information security and reliability). The data is used solely to detect and fix technical errors in the Service and is not used to analyse User behaviour.

b) Analytics Tools

The Service uses Vercel Analytics (traffic measurement) and Vercel Speed Insights (page performance measurement); both are enabled by the single "Analytics cookies" choice. These tools do not store any cookies on the User's device. They are loaded, and analytics events are sent from the server, only after consent to the analytics category has been given. When an event is sent from the server, Vercel Analytics also passes the IP address and request headers, including the Service's cookies, to Vercel. Details on the data processed are provided in the Privacy Policy.

c) Marketing and Advertising Cookies

The Operator does not currently use marketing or advertising cookies. The Service contains no third-party advertising and no tracking for advertising purposes.

IV. Consent to the Use of Cookies

4.1 On the first visit, the User is shown an information bar (cookie banner) with options to accept all cookies, reject optional cookies, or set preferences individually. Analytics tools are not loaded until consent is given.

4.2 Withdrawal of consent: at any time by clicking on "Cookie settings" at the bottom of the website, or by clearing cookies in the browser.

4.3 Duration of consent: 12 months. The choice is stored in the cookie-consent cookie.

6.1 Vercel Inc. and Sentry are established in the United States of America. Transfers take place on the basis of standard contractual clauses under Article 46(2)(c) of the GDPR or the Data Privacy Framework.

7.1 The User has all rights of a data subject under the GDPR (access, rectification, erasure, restriction, objection, withdrawal of consent, complaint to the ÚOOÚ).

8.1 The Operator reserves the right to update this Policy at any time.
